Welcome to the OnePlanet Adventure Trail Collective! These Terms & Conditions (“Terms”) govern your use of our website, mobile app, and services related to the forest visitor center, available through www.oneplanetadventure.com. By accessing or using our website, app, or services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.
1. Membership and Account Creation
1.1 Eligibility
You must be at least 18 years old to create an account and become a member of the OnePlanet Adventure Trail Collective. By registering, you confirm that you are at least 18 years old.
1.2 Creating an Account
To access certain features of the OnePlanet Adventure Trail Collective website and app, you may be required to create an account. You must provide accurate and complete information when creating your account, and you are responsible for keeping your account details up to date. You must also provide a valid passport photo for identification purposes, as part of our security measures.
1.3 Account Security
You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. Please notify us immediately at hello@oneplanetadventure.com if you believe your account has been compromised.
1.4 Replacement Membership Card Fee In the event that a member’s physical membership card is lost, stolen, or damaged, a replacement card can be issued upon request. A non-refundable administration fee of £5.00 (five pounds sterling) will be charged for the issuance of each replacement membership card.
2. Content Upload and Ownership
2.1 Uploading Content
As a member, you may be able to upload content, including text, images, videos, and other media (collectively referred to as “Content”) to the website and app. By uploading Content, you grant OnePlanet Adventure a non-exclusive, worldwide, royalty-free license to use, display, and distribute your Content for promotional purposes related to our services.
2.2 Ownership of Content
You retain exclusive ownership of your Content. OnePlanet Adventure does not claim ownership over your Content, and you are free to remove or edit it at any time, subject to any applicable laws or agreements. However, by uploading content, you confirm that you have all necessary rights and permissions to do so, and that the content does not infringe on the intellectual property or privacy rights of any third party.
2.3 Prohibited Content
You agree not to upload any Content that is illegal, offensive, harmful, or violates the rights of others, including but not limited to:
- Content that infringes on intellectual property rights
- Harassment or defamatory content
- Pornographic or sexually explicit material
- Content promoting hate speech or violence
3. In-App Purchases & Goods
3.1 In-App Purchases
OnePlanet Adventure may offer certain premium features, services, or digital products for purchase within the app or website. All transactions are subject to the terms of the relevant app store provider (e.g., Google Play, Apple App Store).
3.2 Physical Goods
You may also be able to purchase goods (such as products or items) through our website or app. All product sales are subject to availability, pricing, and our return/exchange policy. Please refer to our [insert link to product terms or FAQ] for more information on these transactions.
3.3 Payment & Billing
All payments for in-app purchases or physical goods are processed via secure payment methods. You are responsible for ensuring that your billing information is accurate and up-to-date. For any billing inquiries, please contact us at hello@oneplanetadventure.com.
4. Subscription Plan & Cancellation Policy
4.1 Subscription Terms
The OnePlanet Adventure Trail Collective offers a monthly subscription plan with a minimum commitment of 12 months. After the initial 12-month period, your subscription will automatically renew on a monthly basis unless you cancel.
4.2 Pricing & Payment
The subscription fee is charged on a monthly basis and will be billed to your account. You can find the current subscription price on our website or app.
4.3 Cancellation Policy
You may cancel your subscription at any time after the minimum 12-month term by providing notice via your account settings or by emailing us at hello@oneplanetadventure.com. Once your cancellation request is processed, your subscription will continue until the end of the current billing cycle.
4.4 No Refunds
Please note that we do not offer refunds for any payments made during the subscription term, including the minimum 12-month commitment period.
Right to Increase Fees
Right to Adjust Fees
The Provider reserves the right to increase the subscription fees at any time during the term of this Agreement. Any increase in fees will be made in accordance with the terms set out below.
Notice of Fee Increase
The Provider shall give the Subscriber written notice of any increase in fees at least 30 days prior to the effective date of the increase. The notice shall specify the new subscription rate and the reason for the increase (such as changes in operational costs, inflation, or other factors impacting the provision of services).
Effective Date of Fee Increase
Unless the Subscriber exercises their right to terminate as set out above, the new subscription fee will take effect on the date specified in the Provider’s notice.
5. Promotions, Contests, and Sweepstakes
5.1 Promotions
From time to time, OnePlanet Adventure may offer promotions, discounts, or special offers. These promotions may be subject to additional terms and conditions, which will be clearly outlined at the time of the offer. Promotions cannot be combined with other offers unless explicitly stated.
5.2 Discounts
Any discounts offered as part of your membership benefits cannot be used in conjunction with other discounts or offers. For example, if a product is already discounted in-store, the membership discount cannot be applied on top of that price. Only one discount or promotion may be applied per transaction, unless explicitly stated otherwise.
5.3 Contests and Sweepstakes
OnePlanet Adventure may run contests, sweepstakes, or giveaways through our website or app. Participation in these events is voluntary, and any specific rules, deadlines, and eligibility requirements will be provided with each event. By participating in a contest or sweepstakes, you agree to abide by the official rules and the decisions of OnePlanet Adventure, which will be final.
6. Intellectual Property & Trademarks
6.1 Our Intellectual Property
All content, features, and functionality provided through the website, app, or other services are the exclusive property of OnePlanet Adventure and are protected by copyright, trademark, and other intellectual property laws. You may not use our content or trademarks without our express written permission.
6.2 Your Content
As mentioned, you retain exclusive ownership of your Content uploaded to the website and app. However, by uploading your Content, you grant us the right to use it for purposes related to the operation and promotion of our services, as specified in Section 2.
7. Privacy and Data Protection
7.1 Data Collection
By using our services, you agree that we may collect, store, and process your personal data as outlined in our Privacy Policy. We are committed to protecting your privacy and handling your data in accordance with the General Data Protection Regulation (GDPR).
7.2 Account Deletion
You may request the deletion of your account at any time by contacting us at hello@oneplanetadventure.com. Please note that deleting your account may result in the loss of access to certain features, including any content you have uploaded.
8. Limitation of Liability
8.1 No Liability for Loss or Damage
To the fullest extent permitted by law, OnePlanet Adventure shall not be liable for any loss, damage, or injury arising from your use of our services, including but not limited to any loss of data, financial loss, or emotional distress. We do not guarantee the availability or performance of the app or website at all times.
8.2 Indemnity
You agree to indemnify and hold harmless OnePlanet Adventure, its affiliates, and partners from any claims, losses, or damages arising out of your use of the website, app, or services, including any breach of these Terms.
9. Force Majeure
9.1 Definition of Force Majeure
Neither the Subscriber nor the Provider shall be held liable for any failure to perform or delay in performance of their respective obligations under this Agreement if such failure or delay is due to any event or circumstance beyond the reasonable control of the party affected, including but not limited to:
- Extreme weather conditions (such as storms, floods, heavy snow, or heatwaves);
- Natural disasters (such as earthquakes, wildfires, or landslides);
- Environmental conditions (such as soil erosion, tree diseases, or pest infestations);
- Government actions (including restrictions or directives due to public health emergencies or environmental regulations);
- Acts of terrorism, civil unrest, or war;
- Other circumstances which, despite reasonable efforts, could not have been prevented or mitigated by the affected party.
9.2 Notice of Force Majeure
In the event of a Force Majeure, the affected party shall notify the other party as soon as reasonably practicable, providing details of the event, its anticipated duration, and the expected impact on the performance of obligations under this Agreement.
9.3 Effect of Force Majeure
During the period in which a Force Majeure event occurs, the obligations of the affected party shall be suspended to the extent and for the duration of the Force Majeure event. The affected party will make reasonable efforts to resume performance of its obligations as soon as reasonably possible.
9.4 Right to Terminate
If a Force Majeure event continues for more than 2 consecutive months, either party may terminate this Agreement by providing written notice to the other party. In such cases, any prepaid fees for periods not yet provided shall be refunded to the Subscriber on a pro-rata basis.
9.5 No Liability
Neither party shall be liable for any damages, losses, or costs arising out of or in connection with a Force Majeure event, including any inability to provide access to the forest, membership benefits, or services affected by such events.
10. Personal Use Only, Non-Commercial Usage
10.1 Personal Use
Your membership to the OnePlanet Adventure Trail Collective is for personal use only. You may access and enjoy the forest and other associated services for recreational purposes, including but not limited to walking, cycling, running, photography, or relaxation. Any use of the services for commercial purposes, including but not limited to promotional, marketing, or business activities, is strictly prohibited without the express written consent of OnePlanet Adventure.
10.2 Non-Commercial Usage
You agree not to use the forest, app, website, or membership benefits for any commercial purposes, including but not limited to selling, renting, or otherwise deriving a profit from the use of our services. You may not use any content (including but not limited to images, videos, or written material) you create during your visits for commercial gain without obtaining explicit permission from OnePlanet Adventure.
11. Non-Transferability of Membership
11.1 Non-Transferable Membership
Your membership to the OnePlanet Adventure Trail Collective is non-transferable. This means that you may not sell, assign, share, or otherwise transfer your membership to another person or entity. The membership is granted to you personally, and it may only be used by the registered account holder for the intended personal use, as outlined in Section 12.
11.2 Violation of Non-Transferability
Any attempt to transfer or share your membership, either directly or indirectly, will result in immediate termination of your membership without refund, and you may be prohibited from accessing OnePlanet Adventure’s services in the future.
12. Modifications to Terms
We reserve the right to modify or update these Terms at any time. When we make changes, we will update the “Effective Date” above and may notify you via email or in-app notification. By continuing to use our services after such modifications, you agree to be bound by the updated Terms.
